Why an esos assessor?

The Government estimates that the average large company should realise savings worth £50,000 per year on energy bills as a result of implemented ESOS improvement projects. Energy reductions within large industrial sites can be substantially greater, representing between 20%-40% reductions in energy consumption.

We are currently in Phase 3 of the ESOS scheme. The 4-year compliance phase runs from 6 December 2019 to 5 June 2024.

Who requires an ESOS Assessment?

All UK-based companies that employ over 250 people or have an annual turnover in excess of 50 million Euros, and overseas companies with a UK-registered establishment having more than 250 employees need to have an ESOS assessment carried out.

The Energy Savings Opportunity Scheme was introduced in 2014 to incentivise large UK businesses to implement energy saving measures. ESOS supports UK Government’s zero by 2050 target.
We are currently in Phase 3 of the ESOS scheme. The 4-year compliance phase runs from 6 December 2019 to 5 June 2024.

Requirements:
  • Measure total energy consumption
  • Conduct energy audits to identify cost-effective energy efficiency recommendations.
  • Ensure that at least 95% of your total energy consumption is subject to an ESOS compliant energy audit, a Display Energy Certificate, a Green Deal Assessment or a certified ISO 50001
  • Report compliance to the Environment Agency
Who needs to comply with the Energy Savings Opportunity Scheme (ESOS)?

Companies need to comply with the ESOS legislation if they, or another UK-based company of their corporate group are:

Registered or based in the UK or a UK establishment
Employ 250 people or more or
Have an annual turnover greater than £44m, and an annual balance sheet greater than £38m
SMEs and public sector bodies are generally exempt from the ESOS scheme. It is expected that with the introduction of Phase 4 to the ESOS scheme, the Government will change the ESOS balance sheet and turnover thresholds to align with SECR, requiring more organisations to report on their ESOS.

What ESOS is and who it applies to.

ESOS is an energy assessment and energy saving scheme and is established by the Energy Savings Opportunity Scheme Regulations 2014 (ESOS Regulations). The ESOS Regulations have been substantially amended in 2023, through The Energy Savings Opportunity Scheme (Amendment) Regulations 2023, to make changes to the scheme. Information on relevant legislation can be found in Appendix D.

What happens if my organisation does not comply with ESOS obligations?

There are various ways in which an organisation in scope can fail to meet its obligations for ESOS compliance. These include, but are not limited to:

Missing the deadline
Failing to carry out an energy audit
Carrying out a poor-quality audit
Keeping incomplete or inaccurate records
Publishing false information in your records.
The consequences will depend on how you have not met your ESOS regulations. In some cases, you will be required to take action to bring the ESOS reporting up to the right standard. If you are found to be non-compliant you can expect to receive a basic fine of £50,000, plus an additional fine of £800 per day up to a maximum of 80 days.

The ESOS scheme has resulted in estimated annual efficiency energy savings of 1.65 TWh from buildings,1.51 TWh savings for industrial processes, and 0.52 TWh of fuel efficiency savings across the ESOS population. The changes to the scheme being introduced from the third compliance period onwards are estimated to lead to an additional 28 TWh across all participants over 2024-2037, which equates to an estimated £1.12 billion in energy bill savings for participants over that period.
